Terms of service.

These terms are an agreement between you and Go Penguin Solutions LLC ("we", "us"), the operator of PinScore. By creating an account or using PinScore you accept these terms. If you do not agree, do not use the service.

1. The service

PinScore provides local visibility observations and competitor comparisons for a business you are authorized to manage. PinScore is an independent tool: it is not affiliated with, endorsed by, or operated by Google, and it does not control rankings. Checks are automated observations of public search results and may be incomplete, delayed, or unavailable due to upstream changes. No ranking, traffic, sales, or revenue result is promised or guaranteed.

2. Accounts

You must be at least 18 years old and authorized to manage the business you submit. Provide accurate information, keep your credentials secure, and keep one account per business unless we agree otherwise in writing. You are responsible for activity under your account. Do not bypass usage limits, access other accounts, probe or disrupt the service, or resell observations without our written consent.

3. Subscriptions and billing

PinScore costs $19 USD per month. Your subscription renews automatically each month at the then-current price until you cancel. The allowance is 300 nearby location checks per UTC calendar month; started checks, including failed checks, count toward it. Prices exclude tax; if tax is required, it is shown before you are charged. Payments, invoices, and receipts are handled through Stripe. We will email you at least 30 days before any price change takes effect.

4. Cancellation and renewals

Cancel anytime in the Stripe billing portal - the link is in Account settings and in every receipt. Cancelling stops all future renewals; your plan stays active until the end of the period you already paid. Prefer email? Send any message to [email protected] and that is enough - we cancel, no questions asked.

5. Refunds

You may request a full refund within 14 days of your first payment. After 14 days, cancel anytime to stop future renewals; your plan stays active until the end of the period you already paid.

6. Acceptable use

Do not use PinScore for unlawful purposes, to harass or deceive, to send spam, to scrape or bulk-automate access, to upload malicious code, or to attempt to access data belonging to others. We may restrict or suspend accounts that put the service, other customers, or third parties at risk; where practical, we will contact you first.

7. Your data and our intellectual property

You keep ownership of the business information you submit and your account data. We own the PinScore software, design, and documentation. You grant us the limited rights needed to operate the service for you, such as running the checks you request. Results are for your internal business use.

8. Third-party services

PinScore depends on third parties including Oracle Cloud hosting, Cloudflare connectivity, Stripe billing, Proton email delivery, and Google Maps observations. Their availability and terms are outside our control and may change in ways that affect the service.

9. Disclaimers

Results are dated observations of public search listings, limited by returned search depth and matching accuracy. They are not professional advice and are not a guarantee of future results. The service is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. Nothing here excludes warranties or rights that cannot be excluded under applicable law.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for all claims relating to the service is limited to the greater of (a) the amount you paid us in the six months before the event giving rise to the claim, or (b) $50 USD. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Nothing limits liability for gross negligence, willful misconduct, or fraud, or any liability that Georgia law does not allow to be limited.

11. Indemnity

You agree to indemnify us against third-party claims arising from your misuse of the service or your violation of these terms, to the extent permitted by law.

12. Termination

You may stop using PinScore and cancel at any time. We may suspend or end your access if you materially violate these terms, if the law requires it, or if we discontinue the service. Where practical, we will give notice and an opportunity to export your data. Billing, disclaimers, liability, and dispute sections survive termination.

13. Governing law and disputes

These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Except for claims that may be brought in small-claims court, disputes will be resolved by binding individual arbitration under the rules of the American Arbitration Association, seated in Gwinnett County, Georgia. To the extent permitted by law, you and we each waive trial by jury and the right to participate in a class action. You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these terms. Either party may seek injunctive relief in the state or federal courts located in Gwinnett County, Georgia, to protect its intellectual property or the security of the service.

14. Changes and notices

We may update these terms; material changes will be emailed to the address on your account at least 30 days before they take effect. Continued use after the effective date means you accept the updated terms.
